General Terms & Conditions
for Accommodation Contract

Article 1 (Scope of Application)

  1. All lodging and ancillary agreements entered into by Luru (hereafter "the inn") and guests shall be governed by these general terms and conditions. Any matters not provided for in these conditions shall be governed by applicable laws and regulations or generally established customs.
  2. In the event that the inn agrees to a special agreement to the extent that it does not contravene laws, regulations, and customs, such special agreement shall take precedence, regardless of the provisions of the preceding paragraph.

Article 2 (Application for Lodging Agreement)

  1. An individual wishing to make a lodging agreement with the inn must provide the following information and payment.
    1. Names of all guests
    2. Dates of lodging and estimated time of arrival
    3. Applicable lodging charges (in general, based on the basic lodging charge as per Attachment 1)
    4. Any other information that the inn determines to be required
  2. If guests already staying at the inn place a request during their stay to remain beyond the dates of lodging as provided in item 2 above, the inn shall process the request as though a new lodging agreement has been made from the time of making said request.

Article 3 (Conclusion of Lodging Agreement)

  1. The lodging agreement is concluded when the inn approves the application, per the previous article. However, this may not apply to instances in which it can be proven that the inn did not approve the application.
  2. When the lodging agreement is concluded as per the previous item, the guest must pay the lodging agreement fee as stipulated by the inn, to be no more than the basic lodging charge for the length of their stay (or for 3 days is the length of the stay is longer than 3 days), and by the date as stipulated by the inn.
  3. The lodging agreement fee will be applied to the final lodging fee the guest will pay. In the case that the stipulations of Article 6 or Article 18 are applied, they will be applied to any damages incurred by violation of the agreement, with any remaining amount returned to the guest per the stipulations for refunds under Article 12.
  4. If the lodging agreement fee is not paid by the date stipulated by the inn under item 2 above, the lodging agreement will be rendered null and void. However, this only applies to circumstances in which the inn has informed the guest of the payment deadline for the lodging agreement fee.

Article 4 (Special Agreements that Do Not Require a Lodging Agreement Fee)

  1. Regardless of the stipulations of the item 2 of the previous article, the inn may offer a special agreement that does not require the payment of a lodging agreement fee upon the conclusion of a lodging agreement.
  2. When the inn approves the lodging agreement, if the inn does not request a lodging agreement fee as per the stipulations of item 2 of the previous article and does not set a deadline for the payment of the lodging agreement fee, it shall be taken that the inn is applying a special agreement as per the above item.

Article 5 (Denial of Conclusion of Lodging Agreement)

The inn may deny the conclusion of a lodging agreement under the following circumstances.

  1. When the lodging application does not meet these terms and conditions.
  2. When the inn is already booked and does not have room on the desired dates.
  3. When the inn determines that those attempting to stay pose a risk of contravening laws and regulations, public decency, or established good behavior regarding the inn.
  4. If those attempting to stay meet any of the following criteria.
    • Those attempting to stay are a crime group as stipulated by Article 2 Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Member (Law No. 77, 1991) (hereafter "crime group"), crime group member as stipulated by Article 2 Item 6 of the same law (hereafter "crime group member"), secondary crime group member, in some way affiliated with a crime group or other anti-social force.
    • Those attempting to stay are a corporation or other organization that supports the activities of crime groups or crime group members.
    • Those attempting to stay belong to a corporation with executives who are crime group members.
  5. Those attempting to stay have caused trouble for other quests or neighbors.
  6. Those attempting to stay are proven to be carrying a contagious disease.
  7. Those attempting to stay have made a violent demand or placed a burden beyond the inn's reasonable range.
  8. When the inn cannot provide accommodation due to a natural disaster, functional issues with facilities, or other unavoidable reasons.
  9. When Article 14 of the Fukui Prefecture Inn Law Enforcement Ordinance applies.

Article 6 (Guest's Right to Dissolve Lodging Agreement)

  1. The guest may contact the inn and dissolve the lodging agreement.
  2. When the guest dissolves all or part of the lodging agreement for their own personal reasons (excluding circumstances in which the inn has stipulated a payment date for the lodging agreement fee as per Article 3 Item 2 but the guest chooses to dissolve the lodging agreement before making the payment), the inn may seek charges for violation of the agreement in accordance with attachment 2. However, in the case that the inn has entered into a special agreement as per Article 4 Item 1, charges for violation of the agreement will only be required if the inn has previously informed the guest of the obligation to make payment upon dissolving the lodging agreement.
  3. The inn may process the lodging agreement as having been dissolved if, by 20:00 on the day of lodging (the time set for dinner as part of a plan that includes dinner), the guest has still not arrived nor made contact to inform the inn of their delay.

Article 7 (Inn's Right to Dissolve Lodging Agreement)

  1. The inn may dissolve the lodging agreement for the following reasons.
    1. When the inn determines that the guests risk contravening laws and regulations, public decency, or established good behavior regarding the inn.
    2. If the guests meet any of the following criteria.
      • The guests are a crime group, crime group member, secondary crime group member, in some way affiliated with a crime group, or other anti-social force.
      • The guests are a corporation or other organization that supports the activities of crime groups or crime group members.
      • The guests are part of a corporation with executives who are crime group members.
    3. The guests have caused trouble for other quests or neighbors.
    4. The guests are proven to be carrying a contagious disease.
    5. The guests have made a violent demand or placed a burden beyond a reasonable range on the inn.
    6. When the inn cannot provide accommodation due to a natural disaster, functional issues with facilities, or other unavoidable reasons.
    7. When Article 14 of the Fukui Prefecture Inn Law Enforcement Ordinance applies.
    8. The guests have been smoking in bed, tampering with fire-preventing facilities, or failing to abide by anything else prohibited by the terms and conditions stipulated by the inn (as required for fire prevention).
  2. When the inn dissolves the lodging agreement in accordance with the previous items, no charges will be made for lodging services, etc., that the guests have yet to receive.

Article 8 (Lodging Registration)

  1. Guests shall register the following items with the inn.
    1. All guests' names, their ages, genders, addresses, and occupations.
    2. For guests from overseas, nationalities, passport numbers, port of entry to Japan, and date of entry.
    3. Date of departure and intended departure time.
    4. Any other information that the inn determines to be required
  2. If the guests desire to make the payment as stipulated in Article 12 using a traveler's cheque, lodging coupon, credit card, or other form of alternative payment method to cash, that should be stated upon making registration.

Article 9 (Use of Facilities)

  1. Guests may use the inn facilities between 16:00 and 10:00 the following day. However, when staying for successive nights, they may use the facilities for the entire day, except the days of their arrival and departure.
  2. The inn may allow use of the facilities outside the times stipulated in the previous item. In such a case, the following additional charges will be incurred.
    1. 1/3 of lodging charge for up to 3 additional hours
    2. 1/2 of lodging charge for up to 6 additional hours
    3. Full lodging charge for over 6 additional hours

Article 10 (Adherence to Terms and Conditions)

Guests shall adhere to all terms and conditions stipulated by the inn and posted inside the facilities.

Article 11 (Hours of Operation)

  1. The inn's primary operating hours are as shown below. Pamphlets., etc., will provide details of the operating hours for other facilities, etc.
    1. Operation of services such as the front desk:
      • Curfew: none
      • Staff on call: 16:00 - 21:00, 8:00 - 10:00
  2. The times of the previous item may change as required or in unavoidable circumstances. Under such circumstances, guests will be notified using appropriate means.

Article 12 (Payment of Charges)

  1. A breakdown of the lodging charges, etc., to be paid by guests is laid out in Attachment 1.
  2. The lodging charges, etc., from the previous item are to be paid upon the guests' departure or when billed by the inn, in cash or traveler's cheques, lodging coupons, credit cards, etc., as approved by the inn.
  3. After the inn has provided rooms to the guests and made them available, lodging charges must be paid even if the guest chooses not to stay in the facilities.

Article 13 (Inn Responsibilities)

  1. In the event of the inn causing damages to any guest in the course of performance or non-performance of the lodging agreement and any related agreements, the inn shall be liable to compensate the guest for said damages. However, this provision shall not apply if the damages are not caused by reasons attributable to the inn.
  2. The inn shall not be responsible for the loss of any items the guests bring with them during their stay unless that loss is attributable to willful misconduct or gross negligence on the part of the inn.

Article 14 (Handling of Circumstances in Which Agreed Lodgings Cannot be Provided)

  1. If the inn cannot provide lodging as agreed upon in the lodging agreement, the inn shall—with the guest's prior consent—provide alternative lodgings that meet the same criteria as closely as possible.
  2. If the inn cannot provide alternative lodgings, regardless of the previous item, the inn shall pay a compensatory charge for violating the lodging agreement to the guest, which shall be applied to any damages caused. However, no compensatory payment shall be made if the inn is not responsible for being unable to provide lodgings.

Article 15 (Storage of Guest's Baggage and Personal Belongings)

If a guest's baggage or personal belongings are left behind at the inn after the guest has checked out, the inn will keep them for 7 days, counted from the day of their discovery. The inn will then report them to the nearest police station and dispose of any other items. However, for hygiene reasons, the inn reserves the right to dispose of such items on the day of discovery, during cleaning.

Article 16 (Parking Responsibilities)

When the guest uses the inn's parking, regardless of whether the inn is given the vehicle's keys to look after, the parking space is simply loaned from the inn, and the inn bears no responsibility for managing the vehicle parked there. However, if damages are caused attributable to willful misconduct or gross negligence on the part of the inn regarding the management of the parking spaces, the inn shall bear responsibility for compensation.

Article 17 (Guest Responsibilities)

In the event the inn suffers damages due to any guest's intentional or negligent acts, said guest is liable to compensate the inn for said damages.

(Note)

  1. The % here indicates the % of the lodging charges to be paid as violation charges.
  2. If the number of days for the lodging agreement is cut short, 1 day of violation charges will be incurred regardless of the number of days the stay is shortened.
  3. If there are separate provisions depending on the reservation plan, those separate provisions will always take precedence.
